A novelty search will uncover already existing patents within a specified area. Therefore it is always a good idea to have a novelty search conducted before you decide to file a patent application. In this way you can avoid filing a patent application for an invention, which is already known, and alternatively you can work at improving the technique. A novelty search can be combined with an infringement evaluation. In an infringement evaluation it is established whether commercial use of the invention will infringe existing patent rights. This way you can make sure that you do not infringe third party patents before the production, import or marketing of a new product is initiated.
If you are contemplating registering a trade mark, but you are in doubt, as to whether it infringes earlier rights, Chas. Hude can conduct a trade mark search. Your company’s new idea or the advertising agency’s proposal for a slogan may not be that unique after all. By having a search conducted you can find out at an early stage whether your trade mark is registrable. We also assess, whether the mark has distinctive character as this is a condition for a registration with the Patent and Trade Mark Office.
